Terms of use
The deal, in plain words.
Last updated
These terms are an agreement between you and us for using Winq: the Mac app, your Winq account, the account site and the cloud AI behind it. By using Winq you agree to them. Our privacy policy says what we do with your data.
Who we are
Winq is made by Snkres LLC. "We" and "us" means that business; "you" means the person using Winq.
Your account
- Winq needs a free Winq account on every Mac it runs on. You sign in with a code we email you.
- An account is for one person: use it on as many of your own Macs as you like, but don't share it.
- Any account can sign in on a Mac after the one there signs out; an account is signed in on one Mac at a time. The free trial is once per Mac, whichever account starts it.
- Keep your email working and secure: it's how you sign in. You're responsible for what happens under your account.
- You need to be at least 13, and old enough where you live to agree to these terms yourself.
Free and paid plans
- Free is gaze focus. It stays free, and works offline once you're signed in.
- Starter and Pro are subscriptions, monthly or yearly. They add Winq Intelligence and Presence, and a monthly cloud AI allowance; Pro's is bigger. What each plan includes is on our pricing.
- A launch offer, while it runs, is a discount shown at checkout. It applies as described there.
- We improve Winq all the time, so features can change. If we take something important away from a paid plan, we'll tell you first.
Buying and billing
- You buy Starter and Pro on the account site. Polar runs the checkout and is the merchant of record: Polar sells you the subscription, takes the payment, handles tax and sends your receipts, under Polar's terms.
- The price and any tax are shown at checkout. A subscription renews automatically at the end of each month or year until you cancel.
- Moving up a plan happens at once, and you pay the difference for the rest of the period. Moving down happens on your renewal day.
- Your plan belongs to your Winq account and works on every Mac you sign in on.
The trial
Pro has a 7-day free trial with no card, started in the Winq app, once per account and once per Mac. When it ends, Winq goes back to Free unless you choose a plan. Making extra accounts to get more trials isn't allowed.
Cancelling and refunds
- Cancel any time on your account page. Your plan stays until the end of the period you paid for, then Winq goes back to Free. Your settings are kept and gaze focus keeps working.
- Deleting your account doesn't cancel a subscription. Cancel first.
- Refunds follow Polar's refund policy and the law where you live. To ask for one, write to [email protected].
Cloud AI: allowance and fair use
- Starter and Pro include a monthly cloud AI allowance. It starts over on your renewal day and doesn't roll over. The app and your account page show how much is left.
- When it runs out, cloud AI pauses until it starts over. Summaries written on your Mac keep working.
- To keep the service healthy for everyone, there are limits: on how many calls an account can make a minute, on the size of each call, and on what all accounts together can use in a month. Cloud AI can pause for a while when one is reached.
- Which AI models power cloud AI features can change as our providers release and retire them.
Using Winq properly
Cloud AI is there for Winq's own features. You agree not to:
- use your account's access to the cloud AI outside Winq, or resell, rent or share it;
- get around the allowance, the trial rules, rate limits or the one trial per Mac;
- overload, probe or attack our servers, or try to reach other people's accounts;
- use Winq to break the law, or to make anything that breaks the usage policies of the AI providers behind our cloud AI features;
- copy, resell or reverse engineer the app, except where the law lets you.
If an account is used this way, we can limit or block it. Where we can, we'll tell you why first.
Licence keys from before accounts
A licence key bought before accounts can be redeemed on the account site for one month of Starter. A key works once, and an account redeems once. A key that's already active on a Mac keeps working on that Mac.
The local agent API
Winq can answer coding agents on your Mac through a local API and its MCP endpoint. It listens only on your Mac, at 127.0.0.1, and needs a token. You choose which agents to connect and what they do with it; keep the token private. We're not responsible for other people's software.
Betas
Winq Intelligence and Presence are in beta, and we may mark other features beta too. Betas can change, break or go away. Cards written by AI can be wrong or miss things: check anything important yourself.
What's yours
What Winq reads on your Mac stays yours. We use it only to give you Winq: for cloud AI features, that means passing it to the AI provider that writes your card. The app, the site and the Winq name are ours. We give you a personal, non-transferable licence to use the app on your own Macs while you follow these terms.
No warranty
Winq is provided "as is" and "as available". Gaze picks screens and windows, not pixels, and it will sometimes pick the wrong one. Don't rely on Winq where a wrong focus or a missed card could cause harm. As far as the law allows, we make no promises about Winq beyond what these terms say, including that it will be uninterrupted, error-free or fit for a particular purpose.
Limitation of liability
As far as the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost data or lost work. Our total liability for any claim about Winq is limited to what you paid for Winq in the 12 months before the claim. Nothing here limits rights you have as a consumer that can't be limited, or liability that can't be excluded by law.
Ending
- You can stop using Winq and delete your account any time, on your account page.
- We can suspend or close an account that breaks these terms, or if the law requires it. If we stop offering Winq or a paid plan, we'll tell you in advance, and you keep what you paid for until then.
- When an account closes, its paid features end. The parts of these terms that by their nature should last, such as no warranty and limitation of liability, still apply.
Changes to these terms
We may update these terms as Winq changes. We'll change the date at the top, and for changes that matter we'll tell you in the app or by email before they apply. Using Winq after that means you accept the new terms; if you don't, cancel and stop using it.
Governing law
These terms are governed by the laws of Egypt, and disputes go to the courts of Egypt. If you're a consumer, you keep the protections of the law where you live, and you can also bring a claim there.
